The Customer must read the Terms and Conditions before placing an order (the “Order”). The terms and conditions are available on the website.

FOOD FOR HEALTH reserves the right to adapt or change these general terms and conditions at any time. The version of the General Terms and Conditions that appears online on the website www.foodforhealth.ch at the time of the order applies to each sale. Consequently, placing an order requires the Customer's full, prior and unconditional acceptance of the General Conditions of Sale by clicking on the “I have read and accept the General Conditions of Sale” button.

INFORMATION ABOUT THE WEBSITE AND ACCESSIBILITY OF THE WEBSITE

www.foodforhealth.ch is an e-commerce website owned and operated by FOOD FOR HEALTH.

The Website is generally accessible to all Internet users 24 hours a day, 7 days a week, unless it is interrupted, whether planned or unplanned, by FOOD FOR HEALTH or its service providers for maintenance and/or security reasons or in the event of Force Majeure (as defined below). FOOD FOR HEALTH cannot be held liable for any damages of any kind resulting from the unavailability of the website.

FOOD FOR HEALTH does not guarantee that the website will be free from anomalies, errors or bugs or that the website will function without failures or interruptions. In this regard, you are free to determine the period of unavailability of the website or its contents at your own discretion. FOOD FOR HEALTH cannot be held responsible for data transmission problems, connection problems or network unavailability.

FOOD FOR HEALTH reserves the right to change the website for technical or commercial reasons. If such changes do not significantly and negatively change the conditions for the provision of the Services, the Customer may be informed about the changes that have occurred, but his consent is not required.

REGISTRATION ON THE SITE

In order to place an order, the Customer must first register on the Website by creating an account containing the Customer's information (the “Account”).

The customer's registration on the website is validated by FOOD FOR HEALTH after checking the standard form filled out by the customer. The customer receives an email confirming the registration.

When creating your account, the customer must ensure the accuracy and completeness of the data provided. The customer is obliged to always update his personal data. In the event of an error in providing the recipient's contact details, FOOD FOR HEALTH cannot be held responsible for the impossibility of delivering the products.

By registering on the website, the customer declares and guarantees to FOOD FOR HEALTH that he or she is of legal age and has the legal capacity to enter into a contract.

FOOD FOR HEALTH may terminate Customer’s account at any time and for any reason at its sole discretion.

PRODUCTS

The products offered for sale are those described on the website on the day the customer consults the website, within the limits of available stocks. This information is automatically updated in real time. However, FOOD FOR HEALTH is not liable for an error in the update, regardless of the cause. Therefore, FOOD FOR HEALTH cannot be held responsible for canceling an order of a product due to stock levels.

When presenting and describing its products, FOOD FOR HEALTH takes great care to meet customer requirements as best as possible. However, it is possible that errors may occur on the website, which the customer acknowledges and accepts.

FOOD FOR HEALTH does not guarantee the accuracy or security of any information transmitted or received through the website.

It is possible that the customer will receive a part that was previously returned by someone else following an order. It should be noted that FOOD FOR HEALTH only accepts the return of intact and unopened products and checks these two conditions before returning the returned products to the warehouse.

ORDERS

The execution of an order on the website is subject to compliance with the procedure prepared by FOOD FOR HEALTH on the website, including the subsequent phases leading to the validation of the order.

The customer can select all the products that he would like to place in the shopping cart (the “Shopping Cart”). The products selected by the customer as well as the prices and associated costs are summarized in the shopping cart. The customer can freely change the shopping cart before confirming his order. Confirmation of the order constitutes confirmation that the customer accepts the general terms and conditions, the products purchased, their price and the associated costs. 

A confirmation email containing a summary of the order (product(s), price, availability of the product(s), quantity, etc.) will be sent by FOOD FOR HEALTH to the customer. For this purpose, the customer expressly accepts the use of an email to confirm the content of his order by FOOD FOR HEALTH. Invoices are available in the “My Account” section of the website.

REFUSAL TO PROCESS AN ORDER

FOOD FOR HEALTH reserves the right to withdraw any product displayed on the website at any time and to replace or change any content or information displayed on the website. Despite FOOD FOR HEALTH's efforts to meet the expectations of its customers, they may be required to refuse to process an order after sending the customer the confirmation email summarizing the order.

FOOD FOR HEALTH cannot be held liable to the customer or third parties for any harmful consequences resulting from the removal of a product from the website or from the replacement or modification of any content or information on this website or from the refusal to process an order after sending the confirmation email summarizing the order.

FOOD FOR HEALTH also reserves the right to refuse or cancel an order from a customer with whom it has a payment dispute for a previous order. 

PRICES AND PAYMENT TERMS

The prices of the products are stated on the website in Swiss francs – CHF.

All prices displayed include VAT applicable in Switzerland.

FOOD FOR HEALTH reserves the right to change its prices at any time, but the products will be invoiced based on the prices in force at the time of registration and payment of the order, subject to availability.

The products must be paid for in cash when ordering.

Payment for purchases is made via our payment provider’s secure platform BAND. Stripe, 185 Berry Street, Suite 550, San Francisco, CA 94107, United States

The customer expressly acknowledges that the transmission of his bank card number to FOOD FOR HEALTH constitutes an authorization to debit his account with the amount of the products ordered. If necessary, FOOD FOR HEALTH will send the Customer a notification of cancellation of the order due to non-payment to the email address provided by the Customer when registering on the Website.

The data collected and stored by FOOD FOR HEALTH is considered proof of the order and all past sales. The data collected by Stripe constitutes proof of every financial transaction between the customer and FOOD FOR HEALTH

DELIVERY

Delivery is carried out by Swiss Post from Monday to Saturday, depending on which option the customer chose when confirming the order. Delivery means the transfer of physical possession of the Products to the Customer (the “Delivery”). The shipping costs applicable to the order are those indicated on the website at the time of the order.

Delivery is made to the delivery address specified by the customer, which must be the residential address of the customer, a natural person of his choice or a legal entity (delivery to his company).

If delivery is not possible due to an incorrect delivery address or because the customer is unable to collect their order at the selected collection point, redelivery will not be possible and the customer will receive a refund (excluding delivery costs) within 30 days of receipt of the order by FOOD FOR HEALTH.

FOOD FOR HEALTH delivers orders within a maximum period of 2-5 working days for delivery to Switzerland. This period begins on the first working day after the order is confirmed. 

In order to comply with these conditions, the customer must ensure that he has provided accurate and complete information about the delivery address (such as, in particular: house number, street number, stair number, access codes, names and/or telephone numbers, etc.).

FOOD FOR HEALTH cannot be held responsible for delays in delivery not caused by FOOD FOR HEALTH or justified by an event of Force Majeure (as defined below).

If the delivery deadline is exceeded, the customer may request the cancellation of the sale and receive a refund of the amounts paid on the occasion of the order within a maximum period of 30 days from his corresponding request. Notwithstanding the foregoing, FOOD FOR HEALTH cannot be held liable for any harmful consequences of a delay in delivery, as only a refund of the product is possible by FOOD FOR HEALTH, to the exclusion of any other form of compensation.

RIGHT OF CANCELLATION – REFUNDS AND RETURNS

You benefit from a right of withdrawal of 14 calendar days from receipt of your order. 

The customer must inform FOOD FOR HEALTH of his decision to withdraw by email to team@foodforhealth.ch, stating his order number.

If you return the goods to us, you will be responsible for the shipping costs. Send the goods back to us, well packaged, to the following address

Attach a note with your details (name, address, order number) to the package so that we can identify your return.

You can return the goods to us within 14 days of receipt. You can return the products to us if they are complete, unopened, in the original packaging intact and in perfect, resalable condition. We do not accept products that have been opened or whose original packaging is damaged. We recommend that you pack the goods well before sending them to us so that they are not damaged during transport. Please also let us know the exact reason for returning the goods and the following information: name, address, order number.

Once you have received the package, provided everything is in order and the return has been made within the allowed period of 30 days, you will receive a refund for the products. The refund will be made in the form corresponding to the payment method chosen when placing the order. The refund will be made within a maximum of 10 working days. If you have any questions, please feel free to contact our customer service.

SUBSCRIPTION

“Subscriber” means any natural or legal person who has taken out a subscription.

 “Subscription” means the paid package offered by FOOD FOR HEALTH for the use of the Service, aimed at obtaining olive oil on a monthly basis;

Subscription to the FOOD FOR HEALTH service is bi-monthly (every 2 months). Depending on their needs, the subscriber chooses the number of 3 liter bag-in-boxes they would like to receive every 2 months.  Subscription Membership enrolls Subscriber in the Olive Oil Delivery Service until either party elects to terminate this Agreement. By accepting this offer, the subscriber accepts a direct debit every 2 months for an amount specified in the initial order. Therefore, the subscriber will be charged a renewal fee every two months after the initial order for the duration of the subscription. Subscriber will receive the product within five (5) to seven (7) business days.

The Subscriber may cancel his subscription in accordance with the commitment conditions set out in the “Unsubscribe” section of the General Conditions of Sale below.

By registering, the subscriber declares to have read the General Conditions of Sale, to have understood them and to accept them without reservation with full knowledge of the facts.

Information that allows you to identify yourself, such as: B. Your username and password are personal and confidential. This information can only be changed at the initiative of the subscriber or the company, especially in the event of forgetting the password. The subscriber is solely responsible for the use of his identification data. He is obliged to keep it secret. Under no circumstances can any disclosure by you be attributed to the Company. Any order placed using Subscriber's username and password will be deemed to have been placed by Subscriber. Under no circumstances can the Seller be held liable for any damage resulting from the disclosure of these personal and confidential data by the Subscriber and therefore from the use of this data by third parties. Under no circumstances can the Company be held liable for damages of any kind resulting in particular from the use of the services subscribed to, whether damage to reputation or image or loss of data that may arise from the use of the services offered by the Company.

UNSUBSCRIBE

The Subscriber may cancel his or her subscription at any time in the “My Account” section of the Website.

If the cancellation occurs after the automatic debit for the month in question, the order for the month in question is considered completed. The subscriber cannot make any claim to cancel this order based on the reasons for his request for cancellation. A cancellation will be taken into account for the following month.

In the event of termination, the Customer who benefits from a subscription at a lower price due to seniority will lose this privilege and will be required to pay the current tariff if he wishes to subscribe again.

Unsubscription can also occur through a decision by the company in the event of deactivation of a customer account. In fact, FOOD FOR HEALTH reserves the right to close the subscription and the subscriber's account if the obligations arising from the acceptance of these General Conditions of Sale are not fulfilled, the price of an order is not paid, false information is provided when creating the account or if actions are taken that could harm the interests of the company. The Company also reserves the right to refuse to deal with any customer who has been disqualified or penalized for such actions.
