APPLICATIONS OF THE GENERAL TERMS AND CONDITIONS OF SALE

If you are buying from Switzerland

The general terms and conditions of sale detailed below apply to all orders for products and services placed via this Site (the “Products”) with Route de frontenex, 55 -1207- Genève (Suisse) CHE-480.302.757 TVA (“FOOD FOR HEALTH”) by any person (the “Customer”).

The Customer must read the General Terms and Conditions before placing any order (the “Order”), the General Terms and Conditions being available on the Website.

FOOD FOR HEALTH reserves the right to adapt or modify these GTC at any time. The version of the GTC applicable to any sale is the one appearing online on the website www.foodforhealth.ch at the time of the Order. Consequently, the placing of an Order requires the Customer's full prior and unreserved acceptance of the GCS by clicking on the “I have read and accept the general terms and conditions of sale” button.

SITE INFORMATION AND ACCESSIBILITY

www.foodforhealth.ch is an e-commerce site owned and operated by FOOD FOR HEALTH.

The Site is accessible to all users of the Internet network in principle 24/24h, 7/7d, except interruption, scheduled or not, by FOOD FOR HEALTH or its providers, for the needs of its maintenance and / or security or force majeure (as defined below). FOOD FOR HEALTH shall not be liable for any damages whatsoever resulting from the unavailability of the Website.

FOOD FORHEALTH does not warrant that the Website will be free from defects, errors or bugs, or that the Website will operate without failures or interruptions. In this regard, FOOD FOR HEALTH may freely determine at its sole discretion any period of unavailability of the Website or its content. FOOD FOR HEALTH cannot be held responsible for data transmission, connection or network unavailability problems.

FOOD FOR HEALTH reserves the right to modify the Website for technical or commercial reasons. Where such changes do not materially and adversely affect the conditions under which the services are provided, the Customer may be informed of such changes, but acceptance is not required.

REGISTRATION ON THE WEBSITE

In order to place an Order, the Customer must first register on the Website by creating an account containing the Customer's information (the “Account”).

The Customer's registration on the Website is validated by FOOD FOR HEALTH after verification of the standard form completed by the Customer. The Customer receives an e-mail confirming registration.

When creating his Account, the Customer must ensure the accuracy and completeness of the data he provides. It is the Customer's responsibility to keep all personal information up to date. FOOD FOR HEALTH cannot be held responsible for the impossibility to deliver Products in the event of an error in the addressee's contact details.

By registering on the Website, the Customer declares and warrants to FOOD FOR HEALTH that he is of legal age and has the legal capacity to contract.

FOOD FOR HEALTH may delete the Customer's Account at any time, for any reason, at its sole discretion.

PRODUCTS

The Products offered for sale are those described on the Site on the day the Customer consults the Site, subject to availability. This information is updated automatically in real time. However, FOOD FOR HEALTH is not responsible for any error in the update, whatever its origin. In this respect, FOOD FOR HEALTH shall not be held responsible for the cancellation of an Order of a Product due to the exhaustion of stocks.

FOOD FOR HEALTH takes the utmost care in the presentation and description of its Products to best satisfy the information of the Customer. It is however possible that errors may appear on the Website, which the Customer acknowledges and accepts.

FOOD FOR HEALTH does not guarantee the accuracy or security of information transmitted or obtained through the Site.

It is possible that the Customer may receive, following an Order, a part previously returned by another person. It is specified that FOOD FOR HEALTH only accepts the return of Products that are intact and unopened, these two conditions being checked before the returned Products are put back into stock.

ORDERS

The placing of an Order on the Website is subject to compliance with the procedure set up by FOOD FOR HEALTH on the Website, including successive steps leading to the validation of the Order.

The Customer may select as many Products as he/she wishes, which will be added to the basket (the “Basket”). The Shopping Cart contains a summary of the Products selected by the Customer, together with their prices and related charges. The Customer is free to modify the Basket before validating the Order. Validation of the Order confirms the Customer's acceptance of the General Terms and Conditions, the Products purchased, their prices and the associated costs.

A confirmation email summarizing the Order (Product(s), price, availability of the Product(s), quantity...) will be sent to the Customer by FOOD FOR HEALTH. For this purpose, the Customer formally accepts the use of electronic mail for the confirmation by FOOD FOR HEALTH of the content of his Order. Invoices are available in the “my account” section of the Website.

REFUSAL TO PROCESS AN ORDER

FOOD FOR HEALTH reserves the right to remove at any time any Product displayed on the Website and to replace or modify any content or information contained therein. Despite FOOD FOR HEALTH's best efforts to satisfy its customers' expectations, FOOD FOR HEALTH may refuse to process an Order after having sent the Customer the confirmation email summarizing the Order.

FOOD FOR HEALTH shall not be liable to the Customer or to any third party for any damages resulting from the removal of a Product from the Website, or from the replacement or modification of any content or information appearing on this Website, or from the refusal to process an Order after sending the confirmation email summarizing the Order.

FOOD FOR HEALTH also reserves the right to refuse or cancel any Sales Order placed by a client with whom FOOD FOR HEALTH has a dispute concerning the payment of a previous Sales Order.

PRICES AND PAYMENT TERMS

Product prices are shown on the Site in Swiss Francs - CHF.

All prices include the value-added tax applicable in Switzerland.

FOOD FOR HEALTH reserves the right to modify its prices at any time but the Products will be invoiced on the basis of the prices in force at the time of the registration and payment of the Order, subject to availability.

Products are payable in cash when the Order is placed.

The Customer expressly acknowledges that the communication of his credit card number to FOOD FOR HEALTH constitutes authorization to debit his Account up to the price of the Products ordered. If necessary, FOOD FOR HEALTH will notify the Customer of the cancellation of the Order due to non-payment by sending an e-mail to the address provided by the Customer when registering on the Website.

The data recorded and stored by FOOD FOR HEALTH constitute proof of the Order and of all sales made. The data recorded by Stripe constitute proof of any financial transaction between the Customer and FOOD FOR HEALTH

DELIVERY

Deliveries are made by Swiss Post, Monday to Saturday, depending on the option chosen by the Customer when validating his Order. Delivery refers to the transfer of physical possession of the Products to the Customer (the “Delivery”). The Delivery charges applicable to the Order are those mentioned on the Site at the time of the Order.

Delivery is made to the delivery address indicated by the Customer, it being specified that this must be the address of residence of the Customer, of a natural person of his choice or of a legal entity (delivery to his company).

In case of impossibility to make the Delivery, due to an erroneous delivery address or failure by the Customer to collect his Order from the selected collection point, no reshipment will be made and the Customer will be refunded (excluding delivery charges) within 30 days from receipt of the Order by FOOD FOR HEALTH.

FOOD FOR HEALTH delivers the Orders within 2-5 working days for a Delivery in Switzerland. This period is counted from the first working day after the validation of the Order.

In order to meet these deadlines, the Customer must ensure that he has provided accurate and complete information concerning the delivery address (such as, in particular: street number, building number, staircase number, access codes, names and/or intercom numbers, etc.).

FOOD FOR HEALTH shall not be liable for any delay in delivery not caused by FOOD FOR HEALTH or justified by force majeure (as defined below).

If the delivery time is exceeded, the Customer may request the cancellation of the sale and obtain a refund of the sums paid for the Order within a maximum of 30 days of the request. Notwithstanding the foregoing, FOOD FOR HEALTH shall not be held liable for any damages resulting from a delay in delivery, and FOOD FOR HEALTH shall only be entitled to reimbursement of the Product to the exclusion of any other form of compensation.

RIGHT OF WITHDRAWAL - REFUNDS AND RETURNS

You have a right of withdrawal of 14 calendar days from receipt of your order.

The customer must inform FOOD FOR HEALTH of his decision to withdraw by sending an email to team@foodforhealth.ch, specifying the order number.

When you return goods to us, you are responsible for shipping costs. Please return the goods, well packaged, to

Please enclose a note with your package specifying your details (name, address, order number) to enable us to identify your return

You may return the goods to us within 14 days of receipt. You can return products to us when they are complete, unopened, in their original, undamaged packaging, and in perfect condition for resale. We do not accept products that have been opened or whose original packaging has been damaged. We recommend that you pack the goods well before sending them to us, to prevent damage in transit. Please also state the exact reason for returning the goods and the following details: name, address, order number.

As soon as we receive your parcel - provided that everything is in order and that the return has been made within the 30-day period allowed - you will receive a refund for the products. The refund will be made in the form corresponding to the method of payment you selected when placing your order. The refund will be made within a maximum of 10 working days. If you have any questions, please do not hesitate to contact our customer service department.

SUBSCRIPTION

“Subscriber” refers to any individual or legal entity who has taken out a subscription.

“Subscription” refers to the paid package offered by FOOD FOR HEALTH in order to benefit from the service aimed at receiving olive oil every month;

Subscription to the FOOD FOR HEALTH service is bi-monthly (every 2 months). Subscribers select the number of 3L Bag-in-Boxes they wish to receive every 2 months according to their needs. The Subscription subscription entitles the subscriber to the olive oil shipment service until either party decides to terminate this contract. By accepting this offer, the Subscriber accepts a direct debit every 2 months of an amount defined at the time of the initial order. Thus, as long as the Subscription continues, the Subscriber's renewal will be debited every two months after the initial Order. The Subscriber will receive the product within five (5) to seven (7) working days.

The Subscriber may terminate his or her Subscription in accordance with the terms and conditions set out in the following “Unsubscription” section of the General Terms and Conditions of Sale.

By subscribing, the Subscriber declares that he/she has read and understood the General Terms and Conditions of Sale, and accepts them unreservedly and with full knowledge of the facts.

Information enabling the Subscriber to identify him/herself, such as login and password, is personal and confidential. This information may only be modified on the Subscriber's or the Company's initiative, in particular if the password is forgotten. The Subscriber is solely responsible for the use of his/her identification data. They are required to keep them secret. The Company shall not be held responsible for any disclosure. Any Order placed using the Subscriber's login and password is deemed to have been placed by the Subscriber. The Vendor shall in no event be held liable for any damage resulting from the disclosure of such personal and confidential data by the Subscriber, or from the use of such data by a third party. In no event shall the Company be liable for any damages whatsoever, in particular as a result of the use of the services subscribed to, whether it be damage to reputation or image, or loss of data which may arise from the use of the services offered by the Company.

TERMINATION

The Subscriber may terminate his or her Subscription at any time via his or her “my account” space on the Site.

If termination takes place after the month's direct debit, the Order is deemed concluded for the month in question. The Subscriber may not demand the cancellation of this Order on the grounds of his or her cancellation request. Cancellation is effective for the following month.

In the event of unsubscription, a Customer benefiting from a Subscription at a lower price due to his seniority, will lose this privilege and will have to pay the current rate if he wishes to resubscribe.

Unsubscription may also result from the Company's decision to deactivate a customer account. FOOD FOR HEALTH reserves the right to terminate the Subscription and the Subscriber's account in the event of non-compliance with the obligations arising from acceptance of these General Terms and Conditions of Sale, incidents of payment of the price of an Order, provision of erroneous information when creating the account or acts likely to harm the interests of the Company. The Company also reserves the right to refuse to contract with a Customer who has been excluded or sanctioned for such actions.

FOOD FOR HEALTH reserves the right to adapt or modify these GTC at any time. The version of the GTC applicable to any sale is the one appearing online on the website www.foodforhealth.ch at the time of the Order. Consequently, placing an Order requires the Customer's full prior and unreserved acceptance of the GTCS by clicking on the “I have read and accept the general terms and conditions of sale” button.

INFORMATION ABOUT THE WEBSITE AND WEBSITE ACCESSIBILITY
www.foodforhealth.ch is an e-commerce website owned and operated by FOOD FOR HEALTH.

When creating their Account, the Client must ensure the accuracy and completeness of the data provided. The Client is required to keep their personal information up to date. FOOD FOR HEALTH cannot be held responsible for delivery issues caused by incorrect recipient details.

By registering, the Client declares and warrants to FOOD FOR HEALTH that they are of legal age and legally capable of entering into contracts.

FOOD FOR HEALTH reserves the right to delete a Client's Account at any time, for any reason, at its sole discretion.

PRODUCTS
The Products available for sale are those described on the Site on the date it is viewed by the Client, subject to stock availability. These details are updated in real time. However, any update error, regardless of its origin, does not incur the liability of FOOD FOR HEALTH. As such, FOOD FOR HEALTH cannot be held liable for a cancelled Order due to stock depletion.

FOOD FOR HEALTH takes the utmost care in presenting and describing its Products to provide the best possible information to the Client. However, errors may occur on the Site, which the Client acknowledges and accepts.

FOOD FOR HEALTH does not guarantee the accuracy or security of information transmitted or obtained through the Site.

The Client may receive a product previously returned by another customer. It is specified that FOOD FOR HEALTH only accepts the return of intact and unopened Products. These conditions are verified before returned Products are restocked.

ORDERS
Placing an Order on the Site requires compliance with the procedure established by FOOD FOR HEALTH, involving several successive steps leading to Order confirmation.

The Client may select as many Products as they wish, which are then added to the shopping cart (the “Cart”). The Cart summarizes the selected Products, along with related prices and fees. The Client can freely modify the Cart before confirming the Order. Confirming the Order signifies acceptance by the Client of the Terms and Conditions, the selected Products, their price, and associated fees.

A confirmation email summarizing the Order (Products, prices, availability, quantities, etc.) will be sent to the Client by FOOD FOR HEALTH. The Client explicitly agrees to the use of email for FOOD FOR HEALTH’s confirmation of the Order content. Invoices are available in the “my account” section of the Site.

REFUSAL TO PROCESS AN ORDER
FOOD FOR HEALTH reserves the right to remove any Product displayed on the Site at any time, and to replace or modify any content or information on the Site. Despite its best efforts to meet Client expectations, FOOD FOR HEALTH may refuse to process an Order even after sending the confirmation email.

FOOD FOR HEALTH cannot be held liable to the Client or any third party for damages resulting from removing a Product, replacing or modifying content or information on the Site, or refusing to process an Order after sending the confirmation email.

FOOD FOR HEALTH also reserves the right to refuse or cancel an Order from a Client with whom there is an ongoing payment dispute for a previous Order.

PRICES AND PAYMENT METHODS
Product prices are listed on the Site in Euro – EUR.

All prices displayed include the applicable VAT in the country of delivery.

FOOD FOR HEALTH reserves the right to change its prices at any time, but Products are billed at the rates in effect at the time of Order confirmation and payment, subject to availability.

Products are payable in full at the time of Order.

The Client expressly acknowledges that providing their credit card number to FOOD FOR HEALTH constitutes authorization to debit their account for the amount of the ordered Products. In case of non-payment, FOOD FOR HEALTH will notify the Client by email using the address provided during registration.

The data recorded and stored by FOOD FOR HEALTH serve as proof of the Order and of all sales. The data recorded by Stripe serve as proof of any financial transaction between the Client and FOOD FOR HEALTH.

DELIVERY
Deliveries are carried out by La Poste Suisse, Monday through Saturday, depending on the delivery option selected by the Client during Order confirmation. Delivery refers to the transfer of physical possession of the Products to the Client.

Delivery fees are those indicated on the Site at the time of the Order.

Delivery is made to the address provided by the Client, which must be the residence address, the address of a chosen individual, or a business address.

If Delivery is not possible due to incorrect address or failure to collect the parcel from the chosen pick-up point, no re-shipment will be made. The Client will be refunded (excluding delivery fees) within 30 days after FOOD FOR HEALTH receives the returned Order.

Deliveries within Europe are typically made within 3–5 working days from the first business day after Order validation.

To ensure delivery timelines are met, the Client must provide complete and accurate delivery information (e.g., street number, building number, access codes, intercom, etc.).

FOOD FOR HEALTH cannot be held liable for any delivery delay not caused by its actions or justified by force majeure.

If delivery deadlines are exceeded, the Client may request cancellation of the sale and receive a full refund within 30 days of such request. FOOD FOR HEALTH will only reimburse the Product, excluding any additional compensation.

RIGHT OF WITHDRAWAL – REFUNDS AND RETURNS
You have the right to withdraw from the purchase within 14 calendar days from the date of receipt.

The Client must notify FOOD FOR HEALTH of their decision by sending an email to team@foodforhealth.ch, including the Order number.

When returning merchandise, the shipping costs are at your expense. Please return the items securely packaged to:

Please include a note with your parcel indicating your name, address, and Order number to help us identify your return.

You may return merchandise within 14 days of receipt. Returned Products must be complete, unopened, in their original intact packaging, and in perfect resale condition. Opened products or products with damaged original packaging will not be accepted.

We strongly recommend careful packaging to avoid damage during shipping. Please also include the specific reason for the return and your contact details.

Upon receipt of your parcel—and assuming the return is in order and within the 30-day deadline—you will be refunded using the same payment method originally selected. Refunds are issued within a maximum of 10 working days. If you have any questions, please contact our customer service team.

SUBSCRIPTION
"Subscriber" refers to any individual or legal entity that has subscribed to a plan.

"Subscription" refers to the paid service offered by FOOD FOR HEALTH for receiving olive oil every two months.

The Subscription is bi-monthly. The Subscriber selects how many 3L Bag-in-Box units they want to receive every two months. Subscribing means agreeing to regular deliveries until either party terminates the contract. Acceptance of the offer includes authorization for recurring bi-monthly billing.

Products are delivered within five (5) to seven (7) working days.

The Subscriber may terminate their Subscription in accordance with the “Unsubscription” section of these Terms and Conditions.

By subscribing, the Subscriber confirms they have read, understood, and accepted these Terms and Conditions without reservation.

The Subscriber’s login credentials (username and password) are personal and confidential. They may only be changed at the Subscriber’s initiative or in cases such as forgotten passwords.

The Subscriber is solely responsible for the confidentiality of their login information. Any order placed using the Subscriber's credentials is deemed made by the Subscriber. FOOD FOR HEALTH cannot be held liable for damage caused by unauthorized third-party access due to the Subscriber’s disclosure of login information.

UNSUBSCRIPTION
The Subscriber can cancel their Subscription at any time from the “my account” section on the Site.

If cancellation occurs after the monthly automatic charge, the Order for that period remains valid and will not be refunded. Cancellation takes effect the following month.

If a Subscriber cancels, they forfeit any preferential pricing previously granted based on their subscription duration and must pay the current rate to resubscribe.

FOOD FOR HEALTH may also cancel the Subscription in cases such as non-compliance with these Terms and Conditions, payment issues, false information during account creation, or conduct detrimental to the company’s interests. FOOD FOR HEALTH reserves the right to refuse contracts with any Client previously excluded for such actions.
